Blamdom Term of Service
  The following terms and conditions apply to every registered account on the website Blamdom.com and all corresponding services. When you sign up for the website, you must accept these conditions.

✩ 1 - Availability of our services

       The website and all corresponding services are available 24 hours a day, but this availability may be interrupted due to planned maintenance or unforeseen events. A faultless operation of the website is technically impossible, and therefore we cannot accept responsibility for errors of any kind.

       We always try to ensure that all your data is stored correctly and available at any time, especially the service files provided. However, there may be failures when transmitting, storing, retrieving, or operating these services, resulting in partial or complete data loss. We are not responsible for lost data or damage. You are responsible for using the tools we provide to create backups.

       Furthermore, the website and service availability may disrupt due to server overloads.

✩ 2 - User account

      Access to most functions of the website requires the creation of a user account.

     If your account is locked due to third party login, reset your account with that vendor.

       It is your responsibility to ensure the confidentiality of your account credentials, i.e., your password or your third-party account, and for restricting access to your devices. To the extent permitted by applicable law, you agree that you are responsible for all activities in your account.

       You are solely responsible for any loss of access, such as loss of your password, third-party account, or two-factor authentication. A recovery of access through the linked email address is possible, but not guaranteed. In the event of a complete loss of access, we will not be able to give you access to any account data.

       We reserve the right to refuse access to our website and services and immediately close your account for without providing a reason. This applies if applicable law is violated or our terms of service. In those cases, releasing any data is not possible. Your account may also be removed if your public figure is shown as derogatory across our social platforms (Specifically discord).

       Additionally, we reserve the right to have access to your account and all related services and data at any time without notice and to modify or delete them.

   You can close your account at any time by emailing us at [email protected] or messaging us via discord

   You oversee all servers under your account and must make sure others use them according to the TOS. Others' actions on your servers cannot be changed or monitored.

   Selling your account to someone to make money is stictly prohibited.

✩ 3- Support

   If you have any questions about the services provided, you can contact our support line ([email protected]).

   Especially for questions about content not related to our website, such as third-party plugins or mods, our support might not help you. In such cases, please search for a solution yourself or contact support for that content.

   We use third-party services such as Discord for communication and interaction among users. We do not take responsibility for any support given by other users. All other third-party services are subject to their own terms and conditions.

✩ 4 - Third-party content

   We allow you to upload third-party modifications to your Minecraft server. You need to make sure that the third-party content you install comes from reliable sources and that you respect all the rights of the party involved. This explicitly includes the end-user license agreement for Minecraft/Mojang Studios: https://account.mojang.com/documents/minecraft_eula

✩ 5 - Abuse and limitations

   You agree to use the services provided only for their intended purpose and to comply with applicable law. The abuse of services or the circumvention of the technical restrictions and limitations in place is prohibited.  We reserve the right to immediately delete your user account and all related data.

   While using our service, we must set certain limitations and implement restrictions to ensure the integrity of our system, fairness between all users, and the best possible security for them. It is prohibited to circumvent these restrictions or restrictions.
This concerns in particular:

a.       Upload/download external executable files.

b.       Automatic access to our website or automated actions on our website.

   The commercial usage of our services is prohibited.

a.       Reselling our services is prohibited and will result in account termination.

b.       After seven days of suspension, all server data is permanently deleted.

   Serious abuses like attacks against our website's infrastructure or third parties (e.g., The execution of DDOS attacks or malicious programs), fraud, or other criminal activities can be reported to law enforcement.

✩ 6 - Server data and backups

   We store your server data according to our privacy policy: https://blamdom.com/privacy

   Deleting a server removes all server data and settings permanently. Your server address is also released, and other users can also use your server address. A specific server address is not entitled.

   Backups

a.       We offer the services to create local backups for reverting data to previous versions and preventing data loss from mistakes.

b.       You are entitled for backups given to the amount for your plan

c.       We are not responsible for the availability and functionality of backups.

✩ 7 - Final clauses

   We reserve the right to change our website and services at any time, including these terms of service.

   If this agreement's provision is or becomes legally invalid, or if there is a gap that needs to be filled, the validity of the rest of the agreement is not affected this way. Invalid provisions are replaced by general consent with provisions as close as possible to the intended outcome of the invalid provision.

   If you violate these conditions and do not act against you, we still have the right to enforce our rights if you violate these Terms of Service.

   BLAMDOM IS PROVIDED 'AS IS' WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE COMPANY (OR MANUFACTURER) BE LIABLE FOR ANY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE PRODUCT. THE COMPANY DOES NOT WARRANT THAT THE PRODUCT WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE."
