Hosting Terms of Service (ToS)

1. Introduction & Scope

These Terms of Service ("Hosting ToS") govern your use of all automated, self-service, and recurring hosting products provided by Blamdom LLC ("Blamdom," "we," "us," or "our"), including game servers, web hosting, and reseller hosting.

Note: Custom website development, network services, and managed IT contracts are governed separately under the Blamdom Services Agreement.

2. Billing, Payments, and Terminations

Blamdom operates on a strict billing cycle to ensure the reliability of our infrastructure.

  • Invoicing: Services are billed in advance. Auto-renew is disabled by default. It is the client's responsibility to pay invoices manually before the due date.
  • Suspensions: If an invoice remains unpaid 2 days (48 hours) past its due date, the associated service will be automatically suspended.
  • Terminations & Data Deletion: If a service remains unpaid 14 days (2 weeks) after the initial billing due date, the service will be permanently terminated, and all associated data will be irrevocably deleted.

3. Refund Policy

Refunds are only available within seven (7) days of the initial purchase of a server. Renewals and cancellations outside of this 7-day window are strictly non-refundable.

  • To Request a Refund: You must open a Support Ticket in our client area within the 7-day window and select the specific server associated with the request.
  • Processing: Our team will review the request for eligibility. If approved, the refund will be issued to your original method of payment within 2 to 5 business days.

4. Acceptable Use Policy (AUP)

All hosting services are subject to our Acceptable Use Policy (AUP), which is incorporated into these terms by reference. Violation of the AUP—including resource abuse, hosting illegal content, or unauthorized proxy/VPN use—will result in immediate suspension or account termination without a refund.

5. Data, Backups, and Logging

  • Client Responsibility: Blamdom provides unmanaged hosting. You are solely responsible for creating and maintaining off-site backups of your game servers, websites, and databases. Blamdom is not liable for data loss under any circumstances.
  • Log Retention: For security, troubleshooting, and compliance purposes, Blamdom retains email logs for exactly 90 days.

6. Support Boundaries

Blamdom provides infrastructure-level support. We guarantee the server container/host is online, accessible, and functioning correctly. We do not provide software-level support (e.g., configuring Minecraft plugins, troubleshooting third-party web scripts, or building your website) unless separately contracted.

7. DMCA & Copyright Infringement

Blamdom respects intellectual property rights. If we receive a valid Digital Millennium Copyright Act (DMCA) takedown notice regarding content hosted on your service, we will remove or disable access to the infringing material. Repeat infringers will have their services permanently terminated.

8. Limitation of Liability

To the maximum extent permitted by law, Blamdom LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of your use or inability to use our services. In no event shall Blamdom's total liability exceed the amount you paid for the specific service in the one (1) month preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Blamdom LLC, its officers, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the services, the content you host, or your violation of these Terms.

10. Service Level & Force Majeure

Blamdom relies on third-party datacenters and network providers. We are not liable for outages, hardware failures, network interruptions, or delays caused by events beyond our reasonable control (Force Majeure), including natural disasters, cyberattacks, or upstream provider failures.

11. Governing Law & Contact

These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota.
